Workplace Violence and Harassment

Effective June 15, 2010, Bill 168 came into effect amending Ontario’s Occupational Health and Safety Act. The amendment changed the definitions of Workplace Violence & Harassment, as well as outlined new requirements for employers to implement policies and programs to prevent and deal with Violence and Harassment in the Workplace.

In accordance with the changes to the Occupational Health and Safety Act, Management and the staff of Malvern Condominium Property Management have worked to prepare in depth policies and programs relating to Workplace Violence and Harassment. Below is a brief summary of our policies in this regard.

The Management of Malvern Condominium Property Management is committed to providing a safe, healthy and supportive work environment by treating our employees and clients with respect, fairness and sensitivity. We are committed to the prevention of Workplace Violence and Harassment and are ultimately responsible for worker health and safety. We will take whatever steps are reasonable to protect our workers from Workplace Violence and Harassment from all sources.

Workplace Violence is: the exercise of physical force by a person against a worker, in a workplace that causes or could cause physical injury to the worker; an attempt to exercise physical force against a worker, in a workplace, that could cause physical injury to the worker; or a statement or behaviour that it is reasonable for a worker to interpret as a threat to exercise physical force against a worker, in a workplace, that could cause physical injury to the worker.

Workplace Harassment is: engaging in a course of vexatious comment or conduct against a worker in a workplace – comments or conduct that is known or ought reasonably to be known to be unwelcome. This includes threats and verbal abuse against our staff. Harassment may also relate to a form of discrimination as set out in the Ontario Human Rights Code, but it does not have to.

Violent behaviour in the workplace is unacceptable. Violence & Harassment will not be tolerated from any person in the workplace. This includes colleagues, clients and visitors to our offices. Everyone in the workplace must be dedicated to preventing Workplace Violence and Harassment. Managers, supervisors, workers, clients and visitors are expected to uphold this policy and will be held accountable by the employer.

The Management of Malvern Condominium Property Management recognizes the potential for Harassment and Violence in the workplace. We will therefore make every reasonable effort to identify all potential sources of such risk to eliminate or minimize them. We will not tolerate any type of Violence or Harassment within the workplace or during work-related activities. We are committed to allotting whatever time, attention, authority and resources are necessary to ensure a safe and healthy working environment for all employees and clients to whom we service.

We will take every reasonable precaution to protect an employee from physical injury if we become aware, or believe that Domestic Violence is a risk.

This policy is not intended to limit or constrain the reasonable exercise of Management functions in the workplace. Every worker must work in compliance with this policy and the supporting program. All workers are encouraged to raise any concern about Workplace Violence and Harassment and to report any violent incidents or threats in accordance with the Workplace Violence and Harassment Program. Management pledges to investigate and deal with all incidents and complaints of Workplace Violence and Harassment in a fair and timely manner, respecting the privacy of all concerned as much as possible. There are no negative consequences for reports made in good faith
